Minimum Wage Violations

If you or someone you know has not been paid for the work they have done, not only is it not fair, it is illegal. With proper documentation, you may be in the right for a lawsuit and thus compensation from the lack of pay, breaks, and more.

Though minimum wage laws have been changing a bit in recent years in California, there is no excuse as to why you should not be paid your entire amount. Employers have the legal responsibility to pay you on time, whether it’s out of negligence or abusive behavior.

Although there are some exceptions to the rules, almost all employees in the state of California must be paid the minimum wage as required by law. Since 2017, minimum wage has increased annually, and it is important to stay on top of the yearly changes in knowing your rights.

In California, as of January 1, 2022:

  • Employers with 26 employees or more must pay $15.00/hour.

In California, on January 1, 2023:

  • Employers with 25 employees or less must increase their wage to $15.00/hour.
  • Employers with 26 or more employees will not pay an increased minimum wage.

In Los Angeles County:

  • On July 1, 2021, minimum wage was raised to $15.00/hour.
  • On July 1, 2022, minimum wage will be raised to a determined price based on the Consumer Price Index.

Common Minimum
Wage Violations

Employers have the legal duty to pay their workers in full and on time. However, there are several forms and ways these violations can take place.

  • Failure to pay employees the minimum wage.
  • Failure to pay employees for all hours on the job.
  • Failure to pay employees overtime or other bonuses/bonus rates.
  • Failure to pay employees earned commissions.
  • Failure to properly classify employees as independent contractors, exempt, etc.
  • Failure to allow lunches or breaks for employees.

Additionally, employees who ask and inquire about these minimum wage violations/unpaid wages or file complaints are protected from retaliation from their employers under California state law.

Minimum Wage Violations
Class Action Lawsuits

Typically, when an employer refuses to pay an employee on time and adequately, they tend to treat other employees the same way. Class action lawsuits against an employer are common in minimum wage lawsuits to recover lost and unpaid wages.
