What Constitutes Age Discrimination
In The Workplace?

Simply put, age discrimination is any conduct, behavior, or action where any employer, peer, or group in your office uses your years of experience or actual age against you in a detrimental way. It typically occurs with employees who are 40 or older, but it can happen to anyone at any time.

 There are many ways someone can be discriminated against on the basis of age. Common ways include:

  • Not receiving promotions, career opportunities, or other workplace benefits due to age.
  • Being excluded from meetings, conversations, or workplace activities/opportunities due to age.
  • Being offered inferior pay, benefits, or job tasks/assignments due to age.
  • Having hours cut or even being demoted due to age.
  • Being subjected to business policies and practices that discriminate on age.
  • Being fired, laid off, let go, or even forced to quit due to age.
  • Not being hired due to age.

Typically speaking, age discrimination occurs with a younger supervisor, but it’s not uncommon for owners, manager, supervisors, or other higher-ups to discriminate that are older than you. Additionally, it’s not uncommon for women to experience age discrimination more frequently and at a younger age.

Conduct And Behaviors of
Age Discrimination

Superiors and peers can exhibit age discrimination in various ways. While all the reasons are different to the discriminator, the behavior and conduct is wrong and illegal.   • Older workers being excluded from meetings, training sessions, and other growth opportunities within the company.
  • Evidence of a loss of duties, hours, pay, and any other tasks/assignments.
  • In layoffs, older employees being the vast majority of the workforce reduction.
  • Evidence of policies or practices that affect older employees differently and disparately.
